RULES APPLICABLE TO THE NORMANDIE MEMOIRE LOTTERYI – ASSOCIATION ORGANIZING THE EVENTNormandie Mémoire Association is a non-for-profit association governed by the Act of 1st July 1901 and the Decree of 16 August 1901. Its registered office is at 88, rue Saint Martin, 14000 Caen, [France] Published in OJ of 2 November 2002 under No. 20020044. The Association is organizing and proposing a free lottery without any obligation to purchase, running from the 21th of March 2008 through the 31st of December 2008 at noon. The purpose of the association is to enhance the region’s cultural, educational and tourist resources by organising, coordinating and promoting the development and the operation of sites, museums, and various events related, in some way, to D-Day, the Battle of Normandy, the heroic deeds of the Resistance movement, as well as the memory of the martyrs of the Nazi Occupation and of the civilian victims of the battles to liberate France. Its purpose is further to lead any action developing the Historical Area of the Battle of Normandy, to encourage the local actors to take an active role in the improvement of the overall attractiveness of museums and sites. II- GENERAL PROVISIONSARTICLE 2.1.: ACCESS TO THE RULESThe Lottery Rules are available, 7 days a week, free of charge, on the following Internet site http://www.normandiememoire.com. ARTICLE 2.2.: PRIZEA cash prize of 1000 euros (one thousand euros) will be awarded to one natural person (Participant) whose name will be drawn at random on 15 January 2008. ARTICLE 2.3.: PARTICIPANTSThe Lottery is open to any natural person of legal age residing in France (Metropolitan France as well as its overseas Departments and Territories) as well as in any foreign country, excluding all personnel, the officers and members of the Normandie Mémoire Association, as well as members of their families up to the second degree of family relationship. ARTICLE 2.4.: PARTICIPATION2.4.1. Entry FormIn order to participate, the Participant must completely fill out the entry form in good faith which is given to him/her in the participating Museums or which can be downloaded from the following site: http://www.normandiememoire.com. The Entry Form must then be put into a lottery urn located in one of the Museums. No matter what the reason, failing to fill out an entry form completely and accurately will eliminate any Participant from the Lottery and the possibility of winning the prize. In the event a Participant moves house, changes address or any information concerning him/her changes, he/she must take the initiative to immediately inform the Normandie Mémoire Association thereof at the following e-mail address: info@normandiememoire.com 2.4.2. French Data Protection ActAll of the personal information communicated by each Participant is subject to automatic computer processing declared by the Normandie Mémoire Association with the French Commission Nationale de l’Informatique et des Libertés (French Data Protection Authority) pursuant to the French Data Protection Act of 6 January 1978. As required by law, each Participant is guaranteed a right of access to and rectification and withdrawal of any personal information concerning him/her. All requests should be addressed to the Association Normandie Mémoire, 88, rue Saint Martin 14000 Caen [France] or via e-mail at the following address: info@normandiememoire.com ARTICLE 2.5.: CONDITIONS OF PARTICIPATIONValidation of the entry form by the Participant implies his/her unqualified, full and complete acceptance of the present Rules in their entirety. Generally speaking, each Participant must participate in the lottery in an honest manner in keeping with the present set of rules. Furthermore, the Participants shall refrain from implementing or seeking to implement any automated participation process or, more generally speaking, any process which does not strictly comply with the fundamental principles of Lotteries, i.e. the possibility of winning by chance and individual one-time participation. ARTICLE 2.6.: FREE OF CHARGEThe present Lottery is free of charge and no purchase is required. ARTICLE 2.7.: ORGANISATION OF THE LOTTERYThe Lottery drawing shall take place on 15 January 2009 according to a procedure involving an element of chance, under the supervision of the SCP Varin Jean et Beauquesne Vincent, Huissiers de Justice [Judicial Officers], who shall indicate who the corresponding winner is after having previously verified that the Entry Form was properly filled out. The last day for signing up for the drawing shall be 31 December 2008. The winning Participant shall be informed by e-mail or, for lack thereof, at his/her personal address indicated on the entry form. The winning Participant shall then respond by letter addressed to the Normandie Mémoire Association, 88, rue Saint Martin, 14000 Caen [France], within a fortnight of the aforementioned notice, confirming his/her name and address and enclosing a photocopy of proof of identity (identity card or passport) as well as the particulars of his/her bank account in order for the transfer of the 1000 euros to take place. Failure to respond in full shall render the winnings irrevocably lost by the Participant without any possibility for the Participant to contest or claim his/her share. A new drawing shall then take place in the same conditions defined hereinabove until a new winner is designated. The winner shall then be announced on the following Internet site: http://www.normandiememoire.com within a fortnight of the receipt by the Normandie Mémoire Association of the confirmation by the winning Participant of his/her name and address. ARTICLE 2.8.: WINNINGSThe winnings of the Lottery are as shown below.
ARTICLE 2.9.: CONTESTATIONSAny Participants wishing to contest a Lottery drawing shall do so by e-mail or by letter within two days of the announcement of the winner. ARTICLE 2.10.: RECEIPT OF THE WINNINGSThe winnings are payable by the Normandie Mémoire Association via bank transfer in euros, within 30 days starting from date of receipt of the winning Participant’s confirmation of his/her name and address by the Normandie Mémoire Association. In any case, the Normandie Mémoire Association reserves the right to verify beforehand the identity of the Winning Participant before the actual payment of the winnings. ARTICLE 2.11.: OBLIGATIONS OF THE WINNING PARTICIPANTAny participation in the Lottery Participants automatically gives the Normandie Mémoire Association the following rights concerning the winner, free of charge for one year: - to mention or to use on line or in writing the winner’s surname, first name, country or city of residence in the event of any winnings in his/her favour. - to reproduce and distribute the winner’s photo. ARTICLE 2.12.: EXCLUSIONAny fraud or violation of a provision of present Rules by a Participant can automatically cause permanent exclusion of the said Participant from the Lottery by the Normandie Mémoire Association which reserves the right, if the case arises, to bring legal proceedings against said Participant. Such an exclusion, whatever the cause may be, shall bring about the cancellation of the participation of the Participant concerned as well as of any of his/her earnings. ARTICLE 2.13.: RESPONSABILITES1) Participation in the Lottery implies that the Participant is familiar with and accepts the particularities and limits of the Internet, in particular, the risks of computer failure, connection times, times necessary for processing data, the risks of computer embezzlement, and the risks of intrusion by viruses circulating on the Internet. Further, it is expressly agreed that the Normandie Mémoire Association shall bear no responsibility therefor, in particular, concerning: - Difficulties accessing or connecting to the http://www.normandiememoire.com site and/or its unavailability; - Problems with e-mail forwarding or loss; - Safeguarding and/or integrity of the equipment, software and/or data of the Participants and Internet surfers whether the data is saved on their equipment or on the server of the Normandie Mémoire Association; 2) The Normandie Mémoire Association reserves the right, at any moment, to shorten, extend, postpone, modify and/or cancel the Lottery and such without any liability arising on its part, nor any right arising on the part of the Participants to request any compensation whatsoever in the event of: - fraud on the part of one of the Participants ; - insurmountable, irresistible force beyond the control of the Association or an act of God likely to prevent the smooth running and/or functioning of the http://www.normandiememoire.com site and/or all or part of the Lottery. ARTICLE 2.14.: REGISTRATIONThe present Rules have been registered with the SCP Varin Jean et Beauquesne Vincent, Huissiers de Justice [Judicial Officers], of 27 Place Saint Sauveur, 14000 Caen, France and can be sent to any person who so requests free of charge. |
